Lead Based Paint Rules - Now Enforced

New Federal Lead Based Paint Regulation

If you are currently providing, (or plan to provide) disaster restoration services, -  Structural Drying, Smoke / Fire Cleaning & Restoration, Mold Remediation, or other abatement and/or remodeling services,  YOU ARE REQUIRED TO BE LICENSED AND WILL HAVE TO PROVIDE NOTIFICATION AND REPORTING ON EACH AFFECTED (POTENTIAL LEAD CONTAMINATED) PROJECT.*

The rule addresses lead–based pain hazards created by renovation, repair, and painting activities that disturb lead–based paint in target housing, i.e., in housing built before 1978 and in child–occupied facilities. The rule establishes requirements for training and certifying renovators, other renovation workers, and dust–sampling technicians; for accrediting providers of renovation and dust–sampling technician training; for renovation work practices; and for recordkeeping.

* The State of Ohio is implementing this US EPA ruling effective April  22, 2010.     Many other states are in the process of setting up their own Lead Abatement Rules and Contractor Licensing program as well.  Since this is a FEDERAL RULE, everyone will have to comply, either through their state - or the federal government  program -  for those states that don't develop their own program.

Remember, if you are currently providing, (or plan to in the near future) disaster restoration services, -  Structural Drying, Smoke / Fire Cleaning & Restoration, Mold Remediation YOU WILL BE REQUIRED BY LAW TO BE LICENSED AND WILL HAVE TO PROVIDE NOTIFICATION AND REPORTING ON EACH AFFECTED PROJECT.   Obviously, it would mean jobs where you have to removed baseboard, cove base, drywall, or other structural materials in structures older than 1978.

There are several other factors, such as: "children in the property and pregnant occupants."  Commercial buildings will be impacted by other rules.
